Explanation of Change in CMSI’s Lambretta Styled Scooter Project CMSI, Inc. and its partners KG of Seattle, WA reached an impasse late in 2005 in their discussions concerning how to proceed on the Lambretta project. CMSI and KG are currently working to resolve this impasse and if needed, will submit to binding arbitration to resolve it as outlined in their agreement. However, CMSI had already determined independently of KG , that the trademark Lambretta had been substantially compromised in many countries and was therefore not available for use in worldwide branding. Without clear branding rights, worldwide marketing and sales of the new scooter was in doubt and would make the sales needed for amortization of tooling costs impossible to clarify and achieve. This ambiguity and conflict was pointed out to KG and SIL many times but no resolution was forthcoming. In addition, CMSI’s trademark counsel has advised it that several other users of the trade name Lambretta in their legal business names and/or their products related to motorcycles and scooters, have been in use for decades or longer and that due to the fact that SIL has not sold new scooters into the US market for the last five years, has probably resulted in abandonment of that trade name in the U.S. Because there are substantial royalties associated with licensing the trade name from SIL, these unresolved issues made the economic value of the name questionable, even in the USA market alone. CMSI has substantial investments and commitments in this new scooter project and cannot sit by and do nothing. It is for the above reasons that CMSI has decided to move forward with the SCOMADI project. This classic style has become an icon in the scootering industry worldwide. Due to difficulties in securing clear worldwide rights from SIL for the Lambretta trademark, CMSI and its partners have decided that a new brand will enable the worldwide trademark rights that are essential to breakeven sales and efficient production required to amortize tooling costs for a new model. This brand will be introduced in the U.K. in 2006 and in the North American market by late 2006 or 2007. The basis for the SCOMADI line will continue to be classic Italian style and excellent performance. The initial pre-production prototypes have exceeded 90 mph in trials in the U.K. and U.S. with a Piaggio 250 cc engine. Interesting.... So the name is Scomadi? Or just the brand? Hopefully not the bikes name. Sounds like something that it would take a serious salve to heal. That site appears empty...

hmmm. still no four speed. Genuine seem to be doing well selling scooters named Stella, which look like Vespas ; ) find some frigg'n clutch and a shifter and maybe these new lammies will be worth a shit. |

I can understand the issue over the rights to the name since that has turned into a bit of a mess in the rest of the world. An English buisnessman owns the rights to the name "Lambretta" in Europe. He just happens to be the Lambretta clothing producer and wants nothing to do with the scooter at all! I believe printing the name on a T shirt in the UK could get you in trouble. |

My wife picked up a nice blouse in italy with nice subtle scooter print. She likes it a lot and guess what- it is made by Lambretta! so i think lambretta still has something with scooters- they make clothing with scooter images on them. I still say what we need is a modern electric start, disk brake, electronic variable ignition, geared two or four stroke motor that will bolt into an old series 1,2,3 lambretta frame. Work with rotax in getting something made. Use the barrel, piston, head off of somthing that already exists too cut down costs. Then make frames and bodywork in India and sell it as a kit bike. I would want this over any bajaj, stella, vespa, or any thing else with two wheels.

I look at this a little differently...somebody who sells clothing may have the right to use the Lambretta name on that clothing. They may own those rights, or pay a royalty, or are just stealing the name. That is not the same as doing anything with scooters...its a textile, not a vehicle. This is probably one of the brand issues referenced in the press release. The rest of your post is a great idea. I'd love to see something along this line. RM

They have also breached copyright in the recent past..making stuff with Lambretta based ads on them that they have NO RIGHTS TO at all..and then getting threatening when questioned on the matter. For the record, the item in question was the BLOA (British Lambretta Owners Association) badge. They used it, and had no rights to it at all. |

The BLOA logo, which as I've already stated they have no rights to. After e few emails from LCGB members were met with a very shitty response from the company (ie a threat to revoke their 'generousity' in allowing the LCGB to continue to make T shirts with the word Lambretta on them), they eventually backed down, apologised and donated £1000 to LCGB funds. Big fucking deal....
